Did you say "Roll Over" or "Pull Over"?

Police reform is badly needed in America but it's not going to happen so long as we accept the "Us vs. Them" mindset that is so prevalent in our judicial system today. Note that I said, "judicial system" and not just "the police". Unfortunately, our judicial system is so addicted to the teat of public funds, that it has developed a vested interest in the funding more so than the judgement aspect. As a result, they often work in concert with law enforcement to bilk the citizenry like an ATM machine and then require that you address the "crooks" as "Your Honor".

In the end, the only difference from the criminals that rob you on the streets and the crooks that rob you in the courtroom is that the criminals on the street will bow their head in shame when they get caught.

I learned this truth first hand when I tried to expose the malicious intent from officials in Burke County, North Carolina. I discovered many violations of ethical behavior matched only by their arrogance.

For example, EVERY traffic citation in Burke County, North Carolina is REQUIRED to appear before the DA to barter on the basis of guilt for a lesser sentence. I don’t begrudge the good-will, but the mandate in this process forfeits ANY premise for the “presumption of innocence until proven guilty beyond reasonable doubt”. After all, how serious is this presumption of innocence if one is REQUIRED to barter with the opposition on the basis of guilt? The appalling part is that the officials in Burke County are certainly aware of this obvious transgression and yet, they allow this to happen. I believe it is a reflection of their lack of integrity to even allow such a process, but it gets worse… much worse!

Although the Trooper that recently issued my seat belt citation specifically promised me “a court with a judge”, I was also subjected to this process that violates my Due Process rights. Apparently, the Burke County judiciary is well equipped to run an enterprise, but totally unprepared for judgement but after three court appearances, I was finally allowed to address a court with a judge. I immediately requested a “change of venue” as a result of the lack of trust in a judicial system that subverts my Due Process rights. However, my request was instantly denied without any effort to ascertain why. The immediacy of the judge’s response to my request creates suspicions of collusion with the DA as he was aware of this intent and the judge seemed prepared for it. The problem here is that both the judge and the DA were often absent from the courtroom and this offers the opportunity for collusion. The fact that this is even allowed again reveals a lack of integrity throughout the judicial process in Burke County. This was not previously permissible in the “good old days” but has become routine in Burke County.

Is THIS how the rule of law is practiced throughout North Carolina? In your hometown? The "Us vs. Them" model of policing is dangerous and it belies any claim of "service".

I believe the solution is to recognize dignity as a basic human right. This will change the mindset that is so desperately needed in America. In fact, police reform cannot be genuine without recognizing dignity as a basic human right. And, judicial reform will not happen until we can remove its' reliance on State funding. In the end, it will prove to be unwise to invite a man with integrity into a Burke County courtroom and expect hubris to rule the day.
